These Terms of Use (“Terms”) describe the terms under which Aicall provide subscribers access to and use of Our Service(s) (“You”, “Your”, “Yourself”). By accessing and/or using Our Service,
a) You agree to be bound by these Terms and acknowledge having read our privacy policy.
b) You confirm you are at least 18 years old and competent to enter into this agreement.
c) If accepting on behalf of an entity, You warrant You have the authority to bind them to these Terms.

If You do not agree, please stop using our Service(s) immediately. Hereafter, “Party” refers to either You or Us, and “Parties” refers collectively to both.

1. YOUR RIGHTS
1.1 License – During your subscription, You receive a limited, non-exclusive, revocable license to access and use the Service(s) as specified in your Subscription plan.

2. YOUR RESPONSIBILITIES
2.1 Your Account
You are entitled to use the Service(s) for the number of users outlined in your subscription. Each user must be unique and personal login credentials should not be shared with others.

2.2 Immutable Submissions & File Resubmission
Once You submit personal information (like IDs, proof of address), you cannot modify the submitted data through our platform—it’s immutable to preserve record integrity. If you need to update documents, you may resubmit the files; the new files replace previous uploads, but original data entries remain unchanged. This ensures consistency and traceability.

2.3 Acceptable Use
You agree not to:
a) Sell or resell access to the Service(s);
b) Attempt hacking or unauthorized access;
c) Break any laws;
d) Send offensive or discriminatory content;
e) Distribute harmful software;
f) Scrape data;
g) Send unsolicited commercial communications;
h) Use our Service(s) to build competitive offerings.

2.4 Emergency Limitations
Our Service(s) are not intended for emergency calls, and Aicall assume no responsibility for their misuse in such contexts.

2.5 Call Recording
If available, recording calls is alloAicalld only if compliant with applicable laws; this is Your responsibility.

2.6 SMS Use
You acknowledge SMS functionality follows local regulations and is not guaranteed in all jurisdictions.

2.7 Prohibited Use
Activities Aicall inform you are not alloAicalld must cease immediately.

2.8 Content Warranty
You confirm that any submitted content is lawful and that you hold all necessary rights.

2.9 Billing Terms
Calls are billed in 60-second increments (minimum), with additional charges for short-duration calls as stated.

3. SERVICE(S)
3.1 Trial Periods – Trials are subject to these Terms and may be terminated at Our discretion without compensation.
3.2 Updates – Aicall may improve or add features anytime, subject to these Terms.
3.3 Functionality – Features may change, but Aicall will not materially degrade the Service.
3.4 Maintenance – Downtime may occur with reasonable notice.
3.5 Industry Restrictions – Services are not available for restricted industries; Aicall may suspend or terminate access.

4. INTELLECTUAL PROPERTY
4.1 Aicall own all rights to the Service(s). You receive only a license as permitted.
4.2 You retain ownership of your submitted content; Aicall use it solely to deliver the Service(s).
4.3 Any feedback provided may be used to enhance our offerings without compensation.
4.4 Aicall retain rights to internal techniques and knowledge developed through platform delivery.

5. THIRD-PARTY SERVICES
5.1 Use of integrations is governed by third-party terms—Aicall hold no liability for such services.
5.2 You grant permissions for these third-party integrations you activate.
5.3 Ensuring compatibility and permissions is your responsibility.

6. PHONE NUMBERS
6.1–6.5 Your purchase, activation, compliance, suspension, and portability of numbers are governed under this section, with timelines and responsibilities described.

7. FAIR USE POLICY
Includes usage restrictions for unlimited plans and required cooperation during verification or usage inquiries.

8. CHARGES AND PAYMENT
Outlines subscription billing, administrative fees, payment authorization, plan differences, pricing references, dispute deadlines, refund policy, late payment consequences, fee exclusions, and tax responsibilities.

9. TERM, TERMINATION & SUSPENSION
9.1 You may terminate if Aicall materially breach with a 30-day cure notice.
9.2 Aicall may suspend/terminate for breach, non-payment, or business reasons (30-day cure period applies where feasible).
9.3 Either Party may terminate for insolvency.
9.4 After termination, your data will be retained for up to two years for compliance before deletion; phone services end immediately.

10. CONFIDENTIALITY, DATA PRIVACY & SECURITY
Outlines secure handling of login credentials, mutual confidentiality obligations, data security measures, processing compliance with privacy laws (e.g., GDPR), responsibilities during investigations, and cooperation obligations.

11. DISCLAIMER OF WARRANTIES
Services are provided “AS IS” without any implied or expressed warranties.

12. LIMITATION OF LIABILITY
Aicall are not liable for indirect, punitive, or incidental damages; liability is capped at USD 100 or the maximum permitted by law.

13. INDEMNIFICATION
You agree to indemnify us against claims resulting from your misuse or breaches.

14. MISCELLANEOUS
Includes assignment rights, amendment procedures, severability, relationship status, surviving clauses, notices, publicity permission, export control compliance, governing law, entire agreement, and force majeure.
